When you are injured in a car accident, it is important that you get the full compensation you deserve for your injuries. Understand that everything you say or do prior to filing your claim can have an impact on your eventual settlement or trial.

Read on to learn about some common mistakes that can jeopardize your case and/or reduce the amount of damages you recover.

1. Not seeking medical treatment.

First, it is important that you get the medical treatment you need so you can properly heal from your injuries. Second, your medical condition and your treatment is crucial evidence in your case.  When you delay your initial visit to the doctor, the insurance company will try to use this as evidence that you were not really injured in your accident because it was not enough to require medical attention.

Make sure you attend all follow up appointments and follow your doctors guidance on continued medical treatment.

2. Talking to the Insurance Company. The insurance company is not your friend. They are not looking out for your best interests. An insurance adjustor may try to call you soon after your accident. Understand their job is to protect their company and make the smallest payout possible.

Do not believe everything they say. Do not let them bully you into a settlement. Read our articles Don’t Let The Insurance Company Determine the Value of Your Claim and Tips For Dealing With Insurance Companies After A Car Accident.

3. Posting details on social media. We advise all of our clients to not post information about their accident, their injuries, or their daily activities on any social medial site.  Insurance companies monitor all information they can view publicly and will use it as evidence against you. Your Facebook posts can tank your personal injury case.

4. Missing the statute of limitations. The statute of limitations for a car accident in Nebraska is four years. If you do not bring your case within this timeframe, you will be precluded from doing so.

5. Waiting too long before hiring an attorney. After an accident you are dealing with a lot, we get it — but putting off finding an attorney can seriously harm your case. Also, getting the help of an attorney right away takes some of the burdens off of you. For example, your attorney will deal with the insurance companies on your behalf. That is one less thing you will have to worry about.

We encourage all accident victims to hire an attorney as early as possible in the personal injury process. This allows us to monitor all communication with the insurance company, develop the record of your medical conditions, and timely file all appropriate paperwork with the court.
