Our clients come to us because something horrible happened to them. They are dealing with the aftermath of an accident, high medical bills, lost wages, and other stressors. Most of our clients have suffered severe, life changing injuries. They have hired us to advocate for them and entrusted us with helping them put their lives back together after catastrophe. Our job is to get our clients the most compensation possible under Nebraska law.

In many cases we are able to reach a settlement agreement with the insurance company. We are required to present any settlement offer to our clients. While we may make a recommendation based on our legal experience, it is always up to the client to decide whether to accept or reject a settlement offer.

In some cases we are not able to reach a favorable settlement agreement. This may be because the defendant simply will not make or accept a settlement offer, or will make only an unreasonable settlement offer.

What Happens If My Claim Cannot Be Settled?

If the offer made by the insurance company is inadequate, then a lawsuit may be filed.

We understand that the legal process can feel daunting, especially when you are working hard to put your life back together and recover from injury. The attorneys and staff at Miller Lathrop will do everything we can to make the process as easy as possible for you. We will strive to make sure you understand what is going on in your case and what to expect as your case moves forward.

Typically the litigation process takes about a year. During this time, we will do everything possible to keep your lawsuit moving forward as quickly as possible. However, the process of preparing a case for trial takes time, and court caseloads cannot be avoided or rushed. For these reasons, the ultimate decision to go to trial is yours.

Miller Lathrop covers all costs and fees up front.  If you do not make a recovery in your case, you pay us nothing. To learn more, read our article How Much Will Pursuing My Personal Injury Case Cost Me?

We Are A Law Firm Known For Trying Cases

If a favorable settlement cannot be reached, we are not afraid to take your case to trial. Our attorneys are seasoned jury trial lawyers. What does this mean for your case? It means we are equipped to get you the best possible outcome. Many insurance companies decide how much someone will recover based on whether or not their lawyer actually picks juries and tries cases to a verdict. Insurance companies know us as attorneys who routinely try cases to verdict.

But the decision to accept a settlement offer or go to trial is always yours.

The experienced attorneys of Miller Lathrop can help you recover fair and just compensation when you have been injured in an accident. Call our office today (402)558-4900 to schedule a free consultation.

Our practice has proved that about 65% of all cases we handle are resolved by settlement without ever filing a lawsuit. In 2016, the Nebraska Federal Court reported 1,662 filings for the year. Of these, 230 were civil cases. There were 22 cases tried that same year. So, only about 10% of all cases filed, ever go to trial.  This is our experience, as well.

Miller Lathrop was voted Omaha Magazine’s Best of Omaha, as Top 100 Trial Lawyers by The National Trial Lawyers, The Best Lawyers in America, and attorney Matt Miller holds a 10 Superb top attorney Avvo Rating. We invite you to read what our clients have to say about us here.
